Definition
Expert deposition testimony is sworn testimony in which the retained physician explains the basis for the opinions in his report — the records relied upon, the examination findings, the reasoning connecting the two, and the limits of what the evidence supports.

How testimony follows the report
Testimony is only as strong as the analysis behind it. Reports are written so that each opinion is traceable to a specific record, imaging finding or examination result, which makes the basis for the opinion straightforward to explain under questioning.
Where the evidence does not support a conclusion to a reasonable degree of medical certainty, that limitation is stated in the report rather than discovered at deposition.
Preparation
- Review of the final report and all materials relied upon
- Review of records produced after the report was issued
- Pre-deposition conference with retaining counsel when requested
- Clarification of any opinions affected by new information
